Hello, I am new to this forum but have read a LOT of your posts and so appreciate all of them. And, please forgive me if this question has already been answered - I searched but didn't find what I was looking for. Maybe searched with the wrong keywords.
Anyway, I have missed my first payments this past week and hubby and I are meeting w/a lawyer Thursday to get going on filing Ch. 7. It is just an initial consult but after doing our research and talking w/4 lawyers on the phone we like this one the best, and are prepared to put down a retainer to file Ch. 7. We have $75K in CC debt as well as two car payments (both current). No house, no kids.
Discover has been calling me multiple times a day, and I finally answered today... told them I could not make the payment and we were meeting w/a lawyer this week so of course they flipped me over to their collections agent. After telling him I could not make a payment today he told me that if you had used the card in the past YEAR, you could not file for BK under the new laws. Is this true? If so, I am scr*wed, we have regularly used our CCs for the past several years b/c our expenses were always more than our income (we lived in California and just stayed there too long, period. We have moved now but I am only working p/t and it's not getting the bills paid even w/my husband working f/t).
The charges weren't substantial, probably less than $1000 in the last year on that card, but now I am really starting to worry as our attorney didn't mention this. Is it just a scare tactic? I am not sure if it makes a difference but the charges were for my small business I am attempting to start from home, for a postcard mailer and some customer t-shirts - not exactly for a vacation or anything frivolous!
