Questions after my 341

    Questions after my 341

    Had our 341 meeting on Friday. Continued to 6/26 because our lawyer didn't have a copy of our deed with her. TT said if we provide it by 6/1 there's a good chace we don't have to appear. Few Questions:

    1)When Does the 60 days for objections start now or on the continued date of 6/26?

    2)My husband is involed in a lawsuit from a car accident last year. The Trustee asked about it and then moved right along. He didn't seem too interested in it. Does this mean that if he does receive anything it's exempt? Would he have made an issue about it at the meeting?

    3)Lastly our attorney told us prior to the 341 the our case might be converted over to a 13 b/c of our income; however, the Trustee didn't make any mention of this. In fact, he was pretty easy about everything. My question is, would we have known then if there was a chance of being converted to a 13 or is there still a possibility this could happen.

    1)When Does the 60 days for objections start now or on the continued date of 6/26? I believe on the date originally filed. The creditors have already been notified so if they did not show, they had their chance. Now the clock runs.

This is a possible asset and if your husband prevails, other than his medical and expenses, it is possible they could take some of it.

The Trustee may look closer. The 341 is mostly routine. Once looked at when he has more time, that would be possible. Probably won't happen though if you met your means test.
