    hoa dues after chap7

    i surrendered my house is chap 7, but i keep getting a hoa bill asking for payment and late fees. do i have to pay that? the letter states that if i dont pay i will be responsible for any court fees or attorney fees.

    im pretty sure my lawyer said dont pay because they will just put a lien on property which is already surrendered , is he right? or do i have to pay?

    Yes, you do. You are responsible for all HOA Fees and Assessments, as they become due, for any fee or assessment that was incurred AFTER you filed.

    You will be responsible until the deed shows another name on it. The deed generally changes hand after the foreclosure. However, it could take days or weeks after the foreclosure sale for the deed to be recorded. You may be lucky, in that some Banks, upon foreclosure, pay the past due assessments (HOA). I wouldn't bet on this though.

    If your lawyer said anything about this... it was that you don't need to pay any HOA dues that were billed and due PRIOR to filing.
