    Saw my lawyer again yesterday..

    We are trying to convert from a 13 to a 7 due to a cut in dh's hours/income.
    I had previously posted that my paperwork didn't look right. The income numbers were much lower than dh's actual income and the expenses were less than our real expenses.

    Anyway yesterday we just showed up at the lawyer's office and he was actually there and more than happy to sit down with us. He answered everything completely and he says the numbers used in CH 7 are only for a 40 hour week overtime is never included b/c it's not guaranteed. We went over a list of 12 questions that I had and all in all he says it all looks great and he really sees no reason why it won't go through. He said worst case scenario is we end up borderline and then the trustee could deny a conversion but if that happened he would go to the judge on our behalf to get the decision overturned. He feels 99.99% sure this will go through as planned.

    Our meeting is scheduled for next Friday and I'm nervous as can be but at the same time ready to get it over with.

    Here's a question for you all though. Dh's boss doesn't know we filed BK and dh doesn't want him to know. Our meeting is scheduled for 3:45 pm. Dh has to work that day from 2 pm til 12 midnight. We really need dh to work and not call in sick but what reason does he give his boss for being late? He can't miss this meeting so if he uses a lame excuse and his boss says no then what?

    I told him to say he has a court hearing over a personal matter and he will be in as soon as it's over but dh's is worried that his boss may think he's in trouble with the law then.
    4/09 Converted to a Ch 7 due to loss in dh's income
    5/09 UST now involved no idea what happens next
    7/09 UST has decided to withdraw his motion to dismiss!
    7/27/09 DISCHARGED!!!

    This scenario has been on my mind since we met with our Attorney last Sept. as he requires documentation from my husband's employer on income for the previous six months. He will not use pay stubs.

    As I will be the one requesting this documentation, all I've been able to think of is saying it's required in a Court Case, as I don't or will not lie. Yes, you wonder what the person will think and I'm sure he/she will think the worst.

      Sounds like his wife is having outpatient eye surgery and he needs to drop her off and pick her to take her back home. Shouldn't be more than a couple of hours. LOL

        ROFLOL!

        I have the nerve roots burned in my neck and lower back every 6 months & I'm awake, but get a tad bit of Valium & it's a hassle trying to find a relative or friend that doesn't work to pick you up. My DIL has picked me up several times as her shop is right across the street from the surgery center. She drives me to her shop & I hop in my car & drive the 27 miles back home.

        However, hubby has had to ask off for some of my surgeries & tests. He just goes into his boss & says well wife having something else medically done and I gotta pick her up.

        Good one Mi! or could just say surgery or tests.

            My employer knew I filed bankruptcy....hasn't affected anything. (I'm not the only person there who has had a bankruptcy though).

            I'd just be straight forward and honest, after all you never know when you are going to run into someone that might know the boss or make some comment to him. You'd much rather have you tell him that you have to be at the courthouse than for him to find out from a third party you were late because you were at the courthouse because then he will think the worst for sure.

            His boss might be far more sympathetic than you think.

              I told all of my coworkers about my BK.

              So far I have had three of them come up to me and ask me how to file, how much it costs, etc.

              Last week a younger employee/coworker was sued in SC court. My manager told him to ask me for help. I did and he won! And I am a waitress. Derrr!

              I really think the stigma of BK has pretty much worn its course. It is being used so much for people in foreclosure or close to it, and everyone knows someone affected by the mortgage crisis, that it really doesn't have the social sting that it may have had at one time.

              Maybe just telling your DH's boss confidentially that you have filed will take some of the pressure off and allow you to be able to take additional time of w/o worry if you need it in case your 341 is contnued for some reason .

              These sure ain't the boom years of the dot com age.
