    Yard sale?

    I am in the 60 day club.

    every year my neighborhood has a block yard sale. I always participate.

    I really want to participate but unsure if this is allowed or not. Would I get in trouble for participating in the yard sale?

    I am not selling anything expensive or nice, just the typical junk in the attic like clothing, cooking stuff, maybe some dvds, a few old lamps and so on.

    Can I do it or should I call my lawyer?

      The Courts are not ridiculous, and a yard sale is pennies. They will not bother you. It certainly will not be a great boom in your income, and the Court does allow you to support yourself with a job or two. Go for it. 'Hub

        the yard sale would be fine.. Nothing gets reported to the IRS obviously, so who would know about it anyway?

        Plus, it's not like you'll make thousands.. you'll be fine

          Go ahead an sell them. I was still selling used junk on ebay while I was still in my chapter 7. Attorney says its fine as long as they are not luzury items and you are not making money. It was penny annie items. Like yard sale stuff.

            Let's take this further. Let's say you have a Rolls Royce, super duper expensive mink coat. Just make up an example of a luxury item. There is no lien on it, no debt, you've fully paid up for it.

            You are in financial hardship. What is wrong with selling it on Ebay, reporting it as income, and using the money to pay for living expense? If anything, it would help remove non-exempt assets out of your case. You'd just need to disclose all the sales. The trustee could get upset that he didn't get a commission out of those sales... but, is there any reason why to enter Chapter 7 with any non-exempt luxury items anyways? Shouldn't everyone be selling whatever luxury items they have anyways to live off, in the tough months?

            The way I see it, one has several options:

            1) sell luxury, non-exempt items before filing but report all sales (cash can't be used for preferential payments, but for living expenses)
            2) don't sell, and pretend they don't exist in your filings (dangerous but I'd guess many people who filed did a little of this, ergo all the anxiety about home raids...)
            3) don't sell, and report the items in your personal property (not dangerous, but seems odd to me, as that's money you could have had to live off of)

            Can anyone argue against #1?
