We were all set to file CH 13 on May 22. It's been a long road and we finally paid our attorney and are ready to get this over this.
UNTIL...Yesterday we found on my spouse's job (our main source of income) is being eliminated and he will be laid off June 1. Today, I found out that my teaching job (part-time) with our school district is getting cut due to district/state-wide budget cuts and deficits. So, as of June 1 we will have no income. We are unsure of the severance package (if any) but my husband worked there for 13 years. Don't even get me started if we don't get severance.
We spoke to our attorney and she said to wait and do nothing until June 1. Open up a separte account for any severance money.
I'm really struggling with 2 little ones at home, not knowing if we can keep our home. Our extended family is very prominent in the area and it would be a disgrace if we had to "auction" our home or something like that. We are under-water on our home by about $45k, have a newer car with 3 years left of payments...KBB trade-in value is less that we owe by about 3K.
I need to look at the allowed exemptions to determine where we are with assest, but do most people get to keep their homes or cars in 7? Should I be looking for a rental property? What if my husband gets a job after June 1, but still during the severance and before we are discharged from CH7? Do we have to go to a CH13?
