My previous attorney wanted to prove out my roommates income as well as mine; even with both we had no problems passing the means test. His reasoning was that due to our shared household expenses, the court would want to know how I'm getting by considering I've had very little work and I'm not qualified for unemployment. And its true, my roommate is supporting me big time right now.
However, my new attorney has not asked for any of this information. Instead, I've been told that I simply have to draw up a rental agreement between my roommate and I (we don't currently have one, we have known each other for 20 years and its just not necessary); but if I do it this way, then I would have to show that I'm indebted to my roommate. I have NOT yet paid him for back rent because of the preferential treatment trap.
Any thoughts on this?
