    Filing individually but spouse has more debt

    Is it possible to file individually even if married and list husbands debts. For example, my total debt is $15,000 and his is $20,000. His debts are obviously more, but can I file BK in my name only?

    Since California is a community property state then yes you could do that and it would absolve your obligation to either debt, however he would be responsible for both.

    September 4th, 2007: Discharged and Closed.

      I understand about providing copies of check stubs from previous 6 months. If filling individually, but married, will they require for check stubs from non filing spouse?

        Yes, its your household income and expenses.
