    Chapter 7 and foreclosure

    Quick question for all of you. My chapter 7 is already discharged and closed. I am surrendering a couple of rental homes in the BK. Those were included and discharged in the BK.

    I am now getting notices from the bank saying I am in default and they are going to foreclose if I don't pay. They are also saying I will be responsible for attorney's fees if iit goes to foreclosure.

    I want to make sure I am not responsible for the debt anymore since I am discharged? Do I need to worry about the foreclosure process and attorney's costs?

    The debt has been discharged and the foreclosure is a necessary process for the bank to complete in order to get the collateral. You are not responsible because you have been personally discharged in BK 7 already - the banks remedy is the property only.

    BTW, they have to send you the notices. Ask your attorney for details on the foreclosure timeline if you are still in one of the properties.
