    Job interview before 341? Help!

    I got a call friday afternoon to schedule an interview. I accepted but now don't know how to go about it. Should I say that I can't take it until post 341? Or should I just take it as it will not put me over the means anyways?

    Scheduling an interview and going to the interview means nothing.

    Only if after the interview (1) you are offered the job, (2) you accept the job, (3) you start getting income from the new job BEFORE your 341 meeting (until you get paid, the job hasn't changed your financial circumstances), (4) the new income puts you over the median income for your state or causes significant disposable income on the Means Test and Schedules to appear, and (5) your trustee asks you under oath if your financial circumstances have changed between your filing and your 341.....then with all five circumstances in place then there *might* be an issue depending on how your trustee interprets Ch 7 "future" income after filing.

    Frankly, the chances of getting through the long hiring process for most jobs these days, starting to get paid before your 341 happens, and your trustee then asking about financial changes since filing during your 341 are small.

    If you are filing with a lawyer, ask him/her how your trustee is likely to handle a new job with income actually in hand between filing and the 341. With jobs these days so scarce, you don't want to do anything to jeopardize getting this one. Find out the facts, then decide if this situation is worth worrying about or not.

      Thanks...I will first see how the interview goes...then I will see if I can start post 341 if not then it's not worth jeopardizing my bk.

        Don't ever turn down a job interview in this climate. You can always give a reason to push forward the start date if it's before your 341. For my current job, I interviewed 1st week in Dec '08. Was offered job following week and actually started Feb 2, almost 8 weeks from the interview date. That helped to extend my unemployment period. Then after I started the job, I did not get paid till March 1st so the entire month of Feb counted as zero income in my means test helping to push me under the median for a chpt 7.

          My current job, government, I took test Feb, passed, got interview in April, got job offer shortly after then jumped through tons of hoops before I started in June. Don't worry if you get a job offer they have to do background check, drug test, sometimes a physical ect..... You have time.

            OregonMom.... That sounds promising and is nice to hear. They hired you while you were in the beginning of your bankruptcy for a government job? My BK showed up right away....so, i am sure they saw this on your report and hired you anyway. Great News...

              Actually I got hired a year ago, I hadn't filed just yet was saving the money to file. My credit was in the crapper by then anyway. I don't think they did a credit check though, if they did they didn't tell me about it.

                lrprn it shouldn't matter if OP has already filed. how can the trustee look forward on income. Since you can hit the lottery and keep the money as long as you bought the ticket after you filed.

                  Yep defiantley go to the interview. You are lucky to get an interview now! Looks like your 341 is on May 27 - geez, it could take a long time before you might get offered the job so go ahead and do it.

                  I had several interview for position I thought I was a sure shot at getting offered the job and they ended up not hiring anyone! The whole process took around 5 months with 3 interviews - lots of waiting inbetween - what a bummer!

                      It took you that long? Ironically that's good right now for me. I actually also took a test for a state job and was contacted for interview last month.

                        Sorry to hear that. The same thing might happen to me so I am not too excited right now.

                        There was a job fair for riverside county last month, it was suppossed to be at 9am so I got there about 5 minutes before and there were like 400 people there!!! Luckily the position I applied for wasn't so much solicited as others, but they still haven't contacted me

                          The OP is just having an interview; it will be agreed upon at the time of the interview when the OP signs the paperwork for a background and/or credit check to be run. By that time, the BK will be showing. The OP needs to be prepared for this in case the matter arises possibly affecting her hiring depending on the position, etc.
