    Creditors calling family members

Can anything be done about it. Or am I stuck with it until I either file, or retain a lawyer?

    #2
Yes something can be done. Answer the phone and talk to your creditors. If they can't locate you, they will hunt you down, and they can do this!

The other way is to send them a cease and desist letter. However, this doesn't seem to work with original creditors (like your Bank). Your mileage may vary.

The key is... you need to communicate with them one way or another.

Ah, but if I talk to them, they're gonna try to set up a payment, which I can't send.

Just say no - you don't have the funds but you are working on a plan.

Yes, they will continue to call you. But you can slow down the calls a little this way

Our calls went from daily to about weekly after telling them I couldn't pay. Once I retained the atty, I was able to pass that info on when they called and I have yet to receive another call from anyone who I've informed of the BK and the atty's info.

That's interesting. Do they HAVE to do that, if I request/tell them to do so?

It's Discover. I have 8 other cards with balances, so there will be more.
I'm late on American Express, but they've only been calling my number, so far.
I think it's been under a month late for the first time, with Discover.

If my family member were to tell them not to call at their number anymore, would the creditor legally have to comply?

You must have given out these numbers as supplemental numbers to your own telephone number because I have never heard of a creditor doing this. What have your family members said, something like I have no contact with the you, etc.?

You are bringing back some very bad memories for me ;) When I did answer the phone, they were very pushy and rude. I eventually stopped answering and they kept calling me and also started calling my family members.

Since I was going through a divorce at the time, I blamed the phone calls on my x-wife ;)

A Cease and Desist letter works great for stopping phone calls. Make sure to send it "Certified Mail" with a return receipt so you have proof of them receiving it.

I've read on this forum about family members being called in the past. I was just wondering if they were legally obligated to stop, if the family member told them too. I never gave out those numbers, as supplemental numbers.
