    Please help - what does this mean?

    Spoke to my attorney's office yesterday and they told me they had not heard a thing from trustee's office after they filed 30 day extension for 727 objections 2 weeks ago. I checked PACER this morning and found this, which was dated yesterday:

    <<Notice is given that the Trustee in this case anticipates that funds will become available shortly to produce a distribution to creditors. In order to expedite the administration of this case and make a prompt distribution to creditors, Trustee requests that a claims bar date be set and noticed. Future reports will be made to the Office of the United States Trustee and summarized on the Interim Report which will be made available upon request.>>

    So, to me it sounds like they think I have some assets and will be turning this into an asset case. Other than my tax refund, which I will turn over to them, not sure what other funds they are referring to. What is a claims bar date? Am I correct in hoping this means they are not going to dismiss the Chapter 7 and convert me to a Chapter 13????? If that is what it means it's good news. Would appreciate feedback since none is forthcoming from my lawyer. Thanks, all.

    another thing on PACER

    Okay, I figured out what the claims bar date is. Now my case is an asset case and my creditors have until 7/31 to make a claim. How do I find out what these assets are, other than my tax return and any cash I have in the bank? Will they file something? Geez, without PACER I would have no clue what is going on.

      When I was turned into an asset case (which was at the 341), the trustee filed something called "Stipulation to turn over to trustee." This spelled out exactly what and when I was to turn over to the trustee.

      It seems to me like the trustee should have discussed your non-exempt assets at the 341. Did you file your taxes after the 341? If so, maybe they were waiting to see how much it was before they took it.

        nothing was discussed at the 341 except they asked for my tax return and claimed my refund. Also there was an issue with a $600 (or so) gift of jewelry I made in August '08. Other than that I don't know what assets they could be claiming, I guess sooner or later this will come to light

            I guess the Stipulation is what I am waiting for. I get so nervous I don't read carefully...

              Well your tax refund would be an asset that could be distributed.

                yes, I always expected to give them my tax refund, but what i want to know is what else exactly (total dollar figure). Once that is out in the open I won't be so much in limboland.

                  In truth it could be nothing more than the tax refund.

                  If the trustee decided to go after the gifted jewelry then that might affect who you gave it to you might give em a heads up. I'm not saying he will and if its 600 dollars in truth it might not be worth his effort to do so.

                    I have already agreed to pay the cash value of the jewelry. I just don't want to fight on that issue. The paralegals have discussed this and it's the tax refund, the jewelry and (supposedly) equity in my car. Unless there are surprises I don't know about.
