    ughhhhhh my lawyer bites!!!!!!!

This is really just a vent but I need to vent somewhere!!! I just got off the phone and supposedly my lawyer is in court and wont be back until next week! Background here is they've had my stuff since mid March and have told me AT LEAST 4 times since then that it will be filed within the week. Its like the movie "The Money Pit"!! Only it's not funny!!! They are seriously driving me absolutely nuts! If they filed when they were supposed to, the wait would be half over! I could seriously choke someone! If they told me up front, we are backed up it will be 6 weeks before we can get you filed, I would say "ok" and wait 6 weeks but to be told over and over next week and still nothing! UGHHHHHHHHHH Is there some kind of forum where you can rate lawyers so people who are shopping around can read reviews? I referred someone else to this lawyer and I just called them and told them to go elsewhere, that gives me some peace!

Did you go to the office yet? I still think if you didn't pay yet than go look for some else but since you are waiting for filing my guess is you paid them the fee already. I know that someone said on another thread that there was a Lawyer Bar Association or something like that you can report bad lawyers too but I don't know if that applies here. Others will know more about it than me.

Really though - you need to show up in person for this now or they will jerk you around on the phone forever.

Is the lawyer sleeping at the courthouse or something? That is just a way to stall you out. Sorry but the lawyers have cell phones and are reachable. Plus, if it is a big place I am sure the secretaries might do the filing - it is all done by computer now so it shouldn't be a big deal.

I would go and wait at the door first thing in the morning. If your lawyer is back on Monday apparently, I would be waiting at the door before they open on Monday.

I have paid him in full. That's when the service started to drop! I have not gone to the office to sit there. I am trying to be incredibly polite and patient until it gets filed. Once it's filed then all bets are off! But right now, I am at their mercy and don't want to make matters worse! I am just incredibly annoyed

Better Business Bureau and your State Bar Association will receive complaints. Perhaps letting them know that you intend to complain unless you get some good answers fast may help.
Scared to file. Scared not to file.

Alot of attorneys are nice until you pay them in full and then they have an attitude. I had problems with my attorney. He was sooo good up until we paid him in full and then when I would have a question, they would never out me thru they would take a messgae, BUT before I paid him, he was always available. I would send him an email telling him that you paid him in full and that he needs to do what you are telling him to do. Tell him if he does not file your petition by such and such a date that you are going to complain to the state bar association. I told my attorney if he didn't keep communication with me and do what he was suppose to do, that I was going to call the UST and let them know. Well low and behold the phone rang within 1/2 hour and its been sweet since then. Don't allo him/her to keep pushing you aside anymore. Put you foot down....Goodluck.

              Doesn't that feel good?

I am lucky enough to be able to recommend my Attorney to others - sad that so many can't do likewise.

But put some pressure on them - unless it is a very small office, the Attorney does almost nothing in a BK - the people in his office do it for him and all he does is look over it. NO EXCUSE why they have not filed it except with the possibility the Attorney never receives your messages or knows what is going on. - jb

oh, I so sympathize, I haven't spoken to my lawyer since the 341. Then he disappeared. The paralegal handles everything and she is very impatient with me. But your lawyer is really beyond the pale not even having filed. You have a right to be mad!
                Filed Chap. 7 1/11/09
341 2/14/09; later declared asset case
                Discharged 5/18/09
Asset case - still no payment plan proposed
