Don't be nervous. Educate yourself so you can protect your interests. That's the great thing about this site.

Close the account down and just watch your statements closely. The telephone BofA reps were always polite and helpful in fixing the issue even after the account was closed. Then inevitably the next month it would happen again. So just use caution and watch carefully. Contact BofA immediately if you find a discrepancy. Make sure you save that zero balance statement where you can find it. Good luck!

I had to close my BoA account too but only because I moved to a state where they have no BoA. So that location thingy - I don't agree with it.

It is funny to because I liked being with BoA because their online services are the best I have ever used and didn't want to have to close it but I wasn't about to pay those ATM fees or drive to the next state to go to a Banking Center. So, the girl didn't give me a hard time about closing it because she knew there were no BoA's by me. Plus, I had already taken out all my money and opened a Chase account so I had no more money left in my BoA anyhow. Chase is Ok but their online services suck.

Anyhow, This was six months ago before I started Bk so doesn't matter now but that is weird how they gave you a hard time. Just tell them you are moving to Wisconsin - there are no BoA here you have to drive to Illinois to get to a BoA banking center.

We lived in Hawaii for several years -- no BoA there. We have had the account for years and years though. It's honestly not all that convenient for us regardless of BK issues.

BoA bought out our mortgage lender (after our mortgage lender bought our mortgage from the initial lender about a week after we signed). We are keeping our house and I gave BoA our new acct info for auto pay.

BoA can't raid the new account with that info can they?

i have no autpay from my b of a accts, but pay all of my bills with their online billpay. Should I close these accts? (I have a cc with over 15k on it)....i was just going to leave them open until i file (july) but i will be missing first b of a cc payment on may 1...could they try and take the full min pmt amount out of my account and then charge for negative acct fees?
          waiting to file in july-august,
waiting for Chase to begin foreclosure,
waiting for cc's to begin lawsuits,
          just waiting (& "afraid")...

I'm obviously no expert, but I would switch to a bank unrelated to any of your debts.

Go to www.ripoffreport.com and type in BOA - hundreds of complaints. You are better off closing the account as discussed in this thread.

AfraidofBK if you have money in a BofA account and you miss a payment it's going to disappear to make that payment soon. You need to move that money out of BofA's hands to protect it.

BkTx that is what happened with mine right after she closed it disappeared online - I went and purposely checked - so I think I a good sign for you.

Question to gurus or others here: I will have the same deal with Chase. My case is getting filed this week and I have two Chase cc's that are not getting paid for first time (1 today and 1 tomorrow) and checking account is a Chase.

Should I get my money out of there ASAP?

We had Chase. Move your money out ASAP! Take it somewhere else where you have no prior debt relationship. Chase gave me crap about closing our checking and savings because we also had a few cc accounts with them. But I just kept telling them that I wanted to close the account for location purposes and they closed it. They then tried to reopen it to ding with od charges while trying to pay the credit cards. I was very persistent in my notes and with whom I spoke with and everything turned out okay in the end.

Plus as a side note...Bank of America sucks.....a lot....

                        Good luck.

                          thank eric!

Hmmm, now I am really confused because someone else on another thread told me that once I am filed that I have a stay and Chase can't take any of my money out of my account so I don't have to take it out now but eventually I should switch.

The account is on my BK papers which will get filed in the next few days.

Now, I am not sure what to do. Some people say to get out now and some say (including my lawyer) that it is protected. I had specifically asked him about this a few weeks ago when I signed my papers- can chase take money out of my checking account if I don't pay my cc's? He said "No the checking account is protected."

I guess if I see them take any fees out of my account than I will take action.

Will they not let me close it if I am late on my cc's?

Not sure what to do now.

                            Queenfluff -
I think most of us here (or at least myself) are talking about pre-filing. I have not filed yet, and am trying to plan accordingly as I miss CC pmts

We chose to err on the side of caution, but I don't think your lawyer would steer you wrong and obviously he knows the details of your situation and law whereas I think most of us are going on personal experience and generalities.

Good point. Well, I think I am going to "ride-it-out" and see what Chase does. I think if I really needed to remove myself from Chase the lawyer would have said something. I have actually been a super looong time Chase customer. It was First Chicago, than Bank One, than Chase. I did close out accounts once when I moved to where there was no Chase and open it up back again (hence the BoA switched too when I moved) - maybe they won't try to dip their fingers in my account. We shall see.

Should be an interesting next couple of weeks for me.
