job offer after 341...need some advise

    I guess the safe route is after the 341 but why would it matter if it was before?? Since you've already qualified based on the previous 6 months. I understand the pending settlement thing but that something you knew about before filing and technically part of the BK Estate. Unless you knew you were going to get a million dollar job before discharge, I don't see how it would matter.
    I guess my concern is that if there were any delay in the discharge (well past 60 days, like jessegirl) that they review the file and say "wow, you were making $18k a year and now you make $65k? You get to go Ch. 13!"

    I have a call into my lawyer but I guess I was hoping someone that it actually happened to would pipe in with firsthand experience. I don't know the system here, what makes a guru and a mentor....

      the trustee works for a legal office that also deals with tech issues. i teach computer science and technology... it was surprisingly refreshing and the whole 341 was so comforting to know that these guys are human too

        Take the job, my attorney told me the file date is important snapshot date , definately move on with your freshstart.

          took a job between filing and 341...what a dilema

          Great to find this thread, any advice/similar experience sharing is much appreciated to all gurus...our lawyer is useless. And we live in New York

          My wife and I filed for joint Ch 7 on April 7 after both lost our jobs for over a year. She was able to land a full time job (thank god) last week and we are waitng for our 341 meeting on May 14th. How would this impact our case? The following is snapshot:

          1. Family of 4 living on unemployment benefits ($1,700/mo) for at least 6 mo prior to filing on April 8.
          2. Income from the new job will make us on the brink of passing/missing the means test although I know the test is based on 6 month average income PRIOR to filing.
          3. We are $200k in cc debt and there is no way to go into Ch 13 to pay off them, so Ch 7 is really a make or break for us...

          We are even thinking of her leaving her new found job to get a better shot at the 341...what a painful dilema...

            Keep the job. You have already filed and your 341 is soon. If the Trustee asks about employment, naturally tell him/her about the new job.

              thanks Startingover08. I was just wondering exactly what the Bankrupcy Code says...like the filing date is the rock solid cut-off time or it really depends on the district and trustee regarding converting to Ch 13, which has to have our consent right?

              To our original OP: how did your 341 go? any employment questions?
