I am currently in my waiting period for my discharge and I have a car that I am not planning to re-affirm. Originally, I had planned on reaffirming but after I thought about it (paying $9900.00 for a car worth about $2000.00) I changed my mind and decided to not make any more payments and ride it out until my discharge and then turn the vehicle in. I also contacted the lender to see if we could negotiate my reaffirmation terms, with no success. However, the lender decided to file a motion of relief and the court date is set for May 7, although my earliest possible discharge date is June 10. Now I'm caught because I need my car but I was told any time after the court date, they can come and pick up my vehicle. Plus, I am having a hard time getting another vehicle because the dealerships want that discharge paper. What am I suppose to do? What options do I have?

I'm sorry that the creditor can't even wait to lift the stay. However, as I understand it the repo guys are very, very busy. It might take longer to send someone out than June 10. Normally you would just not respond with the reaffirmation agreement timely to avoid this situation.
In the meantime, you may want to see about other forms of transportation (rental/friend etc.) until you get your official discharge. The only other thing is getting a low cost beater to use after the car is picked up and before you get the official discharge. (Temporary transportation). The discharge makes a big difference in your ability to get good financing.Filed CH 7 9/30/2008
