      IMHO, you don't owe an explaination to anyone, Kingxray.

      Nevertheless, when you post that you're getting sued by family over money and family hires a lawyer to make your bankruptcy worse... well, it certainly peaks peoples' curiousity. Most people don't have a parent like that.

      I'm sorry your Dad is like that. It's drama worthy of those daytime TV talkshows for sure.

        Thanks to those of you who were supportive. This has been an ongoing nightmare for over 3 years and we just want it to end and get our lives back. It is not easy to lose the only family member you have over money. I have 3 boys who are grown and have given them thousands of dollars never expecting to get it back (and never did). I love my boys and would never put them through what my dad has put us through.

        Chad, I have to agree with the others, you are a moron.

              have you filed for bankruptcy? is there a point you are here, please tell us all your wonderful story so we can judge you and your family, as you see fit to do to others..... oh and by the way just as you said to the OP " i could never imagine not paying my dad back" let me say to you.... if you have filed bankruptcy.. are you paying all your creditors back? as some people could never imagine not doing that... wow! same goes or you right?

He started this nightmare and now we are going to end it.
                Here's another opinion. Since you have clarified your story then yes you dad is a Jackass....

                      kingxray - I'm sorry you felt you were put in a position to have to explain yourself. Though you may feel alone in extended family, you are not alone in support. Though my mother hasn't sued me (yet) she is cut from the same cloth as your father. Everything has always been about money with her and how to get it out of others. When my grandmother died she told me that my grandmother hated me and left $1 to me so I couldn't contest the will. I was 19 when that happened and didn't know any better. A few years ago I finally ordered a copy of that will and it turns out she left a lot more than that to me. Her estate was worth $1 mil and my mother took it all. The problem was the will was written while I was still a minor and named my mother executor. My grandmother's dream was for to pay for my University education and living expenses while doing that and then buy a house after graduating. I feel so sad that it didn't go that way. I haven't spoken to my mother in over 5 years, not about the will or money but just her greedy manipulative behaviour was too much for me. I'm sure she is looking in on how to sue me because the checking account that I bk'd had her as a co-signer. I had that account for 15 years so it was opened during a time when we were still on semi good terms.

                      Now, back to the original post. How long do you have to wait to refile? Is there any way other than bk to get an injunction on the wage garnishment since you no longer have a job? Let us know if there's anything the BK Gurus and google masterminds can help you with!

                      01/27/09 - case dismissed and closed - 02/24/09 - case reopened and dismissal vacated
                      04/01/09 - new 341 scheduled
                      6/02/09 - DISCHARGED!!!

                        And to clarify...

                        I have seen "children" take advantage of their parents causing extreme financial hardship. These "children" are the scum of the earth because they are taking advantage of "family." They are making their families the victims of their greed. I have seen "children" take everything from a parent and then disappear. I have been to homes where the "elderly" parent doesn't have food because their child took the money. So yes I take offense to situations like this.

                        My original post did not reflect my true feelings. In fact my post stated "didn't know which side to take." Personally, I think these children should be shot. Kingxray clarified her story.

                        I stand by what I said earlier...if you post things in a public forum people are going to have opinions.

                          OMG, it is like looking in the mirror. My dad is just like your mom! I have years of stories of his greediness. I should have known better than to get in a deal with him.

                          The lawyer wants to file the day we are dismissed. My concern is that since our original filing date of Oct. hubby received several bonus and we got a sizable tax refund but I also lost my job. We have already spent the money on household upgrades, so I am not sure what the trustee is going to have to say about it. She told our lawyer she would not contest our refile. Lawyer is on vacation and he is not aware of the bonuses, tax refund but he does know about my job loss.

                          We were told originally that BK was the way to go to get rid of my dad and his liens and garnishments. I have not heard of any other avenues to take, unless someoone here knows of one. Thanks again for your support.

                            I'm glad you can refile immediately. I was worried you might have to wait 6 months and let them attack you for that period.

                            Sounds like we could swap some good stories. My mother figured out that cancer support groups are a great place to find future husbands. Oh, she doesn't have cancer but likes the older gentlemen who do and have money. I kid you not. When I looked into my grandparents finances after ordering the will, I saw that my grandfather started purchasing bonds the day I was born. Every paycheck he purchased another until he passed away. I had dreams when I was a young mother and struggling with the bills and feeding my daughter of my grandfather comforting me and telling me it didn't make sense that I was struggling like this because he took care of me. I didn't know about the bonds at that time but sounds like a message was being sent.

                              Business went belly up...Economy Sucks...lots of debt
                              Bought a house....Housing Market went to hell

                              So basically I have $40,000 in CC debt, and a house that is underwater by $150,000.

                              I've had TWO jobs for almost a year and half. The 2nd job no longer exist so that cut my income by $10-$15K . Business did not get off the ground because of the economic downturn.

                              My debt is mostly business debt and home improvement. I've have not had a vacation for almost two years. I live frugally but still sinking. If the economy hadn't affected my business or 2nd job I would have never considered BK. I would of just been paying my debt for the next 30 years.

                              So in many ways the economic downturn saved me. I don't feel bad for BKing either, since the banks caused $150K loss in my house. I now have 5 rentals in m neighborhood and at least 2 active short sales. My neighborhood is going in the toilet fast! I don't know if I should stay or run away.

                                Wow blankslate sounds like you have seen your share of heartache, as I have. It is time we shed these nasty people from our lives and be thankful for the loved ones we do have. Lets be glad we did not turn out like our parents!

                                I am dreading going through this again and another 341. I sure my dad will send his lawyer to the 341 again and have him grill me like he did at our last one but hopefully this time the outcome will be different.
