    We had our 341 meeting we are planning on referming the house we have never been late on a payment,nobody showed up to sight any papers,our lawyer told us that was fine and to keep makeing the payments,but my neighbor said that they can still take the house when ever they want even if we have never missed a payment because of the BK,we still get a bill and I just sent it off I am scared to call them and raise any flags,we are with COUNTRY WIDE

    Somebody correct me if I am wrong, but they can come for the house if they want, but don't normally do if payments are current. You do need to reaffirm here soon so they won't come and get it, but you cannot walk away from after reaffirming like you could if you never reaffirmed and just made payments. You will have to call and raise red flags to reaffirm so just do it, they don't want another empty house with no payments coming in.

      It might be state specific but I believe the lender can't foreclose without going through the foreclosure process. That means you have to be in default and receive a Notice of Default! So I don't think they can just take your house. How would they force you out. They'd have to go to court and get an order. The sheriff would not act on civil order w/o an order from a judge.

      As for a car I believe you are correct but I also believe there is case law saying they can't repo if you're current.

        Also, my attorney told me reaffirmations were on me and to contact the lenders myself.

          If you are current they cannot start foreclosure on you
