I'm obsessing over whether we'll have to file a 7 or a 13 and hope someone can help shed some light. I've consulted with 4 attorneys but they all just went over the BK basics which I mostly already knew from coming here. (thank you). They said we can probably do a 7 but for them to look at everything, I'd have to make a down payment first.
We're $2,000 over the median income but have high medical expenses this year. So according to the means test we are probably eligible for Chapter 7.
I think we can make payments on our portion of my husband's upcoming surgery, but the dentist had to be paid in full with cash or credit card. The work was necessary, not elective.
We were already deep in cc debt. The dental bills, along with me losing my job, have wiped us out. We have no assets.
Do the trustees take into account that the big dentist payments are a one year expense and not on-going?
