    Job, Sole Proprietorship and Chapter 7

    My husband has a job and we have a few things that we do listed under sole proprietorship such as independent distributors for a couple of products, home cleaning, bookkeeping services etc. We are well under the income on the median income chart taking numbers from our adjusted gross income. I haven't taken a means test though.

    What I understand is that if your debt is primarily consumer debt the means test applies so we would qualify. If your debt is primarily business debt it does not apply and there are some other calculations. If you are already under the income median would you automatically qualify with business debts. It looks to me that those other calculations would be important if you didn;t pass the means test you could use those and still qualify.

    If it's a sole prop, then all of the "business" debts are your personal debts for these purposes. I'm in a similar situation. The few debts that are actually in the name of my LLC all have my personal guarantee on them so it doesn't matter anyway.

      Do you do the disposable income test regardless if it is mainly business debt or consumer debt?
      Why is there even a differentiation between the two?
