I just posted yesterday about an inheritance that my husband is due to get. His mother passed away 2 weeks after our 341 meeting. From everything I've read on here, he has technically inherited that money already and the bankruptcy court will take it.
My lawyer, after supposedly speaking to the estate lawyer, has said that he won't be getting most of that money for quite awhile (the trust portion).....way after the 180 day time frame. She said that we won't have to give that money to the court since that is the case. The IRA portion may be a different story.
Now, she IS a bankruptcy attorney.....with a good reputation.....
Should we be worried that she may be wrong? We don't want to end up in a bad, bad place.
Didn't I read that they always come back when you finally do receive the inheritance even though it has been held up in probate?
