My lawyer should be filing any second (I hope I hope I hope) Anyway, I just checked a checking account we have (dh gas, lunch etc..) anyway, he has got $215 in od fees!!! Hes out of town and I put money in there and told him so he could take money out...anyway, for some reason the deposit didn't post until the following Monday so all these little purchases came through and the deposit wasn't there and bam... $215!!!!!! I am going to go in there tomorrow, politely, and ask to explain why the deposit didn't come through blah blah blah and if they don't refund, there is NO way I am paying it!! Assuming they don't refund them, can I IIB? Do I need to wait until chargeoff? We have other checking accounts, so I am not worried about the chex thing, although it would tick me off! If for some miracle my lawyer actually files before I find out, would it need need to be listed or is it any debt it is included? All I know is I am NOT paying any of those fees!

$25-$35 is pretty standard at most banks for overdraft fees..
When did you make your deposit though? It sounds like it was after their cutoff time (usually fridays after 5pm, and saturdays dep would post tues). I would first make sure that you are aware of the policies in that regard; and when you go in- don't be mad.
Seriously, i know you said you would be polite- but believe me- the bankers will know that you're p--d off and will likely refuse to reverse anything. If you're friendly and talk with the banker- they would probably help out with some. Also, keep in mind that if you did make the deposit after the cutoff time; you're also responsible so they may not reverse everything.
you can include a charged off account in your BK- that would put you in Chexsystems; and most banks won't open an account if you're on there.. Except US Bank and Wells Fargo that i have heard of. I believe there are some posts on here about getting off of chexsystems after your case is discharged. Just be aware of that situation..

I am still sooo fuming! I made the deposit on Friday @ 3:00. I went home and looked online and it was in the available balance, so I assumed it was available! Then I told DH, it's in there you can go to the store. He got gas, groceries and rented 3 movies from the red box thing at $0.99 each...that was 3 od charges for $0.99 a piece. I will ask to refund, and I will be polite and ask for help. I was a mgr at a bank in a previous life so I know what works and what doesn't! 5 od charges is a lot to refund so if they don't, I want to make sure it can be discharged if its not listed in the BK petition... Again, my lawyer is supposed to file any time now and its not even charged off. Hopefully, they will refund them and all is well and I am stressing over nothing...I will know tomorrow!Filed CH 7 05/06/09

I had WAMU like 10+ years ago. They had an overdraft program that was really a cash advance program. Unlike Wells Fargo, they charge each time you used it. Didn't matter if it was for 1 cent or $300 dollars they charged $25 for each time. Wells Fargo charge the same fee but you could advance up to $300. WAMU did not tell me about this program and when I tried to cancel it from my account they refused. It made them too much $$$
As for the deposit it was deposited on a Thursday but didn't show up until Monday. It was a scam. So from Friday to Sunday I ran out of money...I think I had 3 transaction that equaled less than $3 yet I was charged $75 in fees. BS! I changed banks...

WooHoo! Good One! You must be a persuasive talker! I suck at it. I would have told them I used to work at a bank - that way they know they can't put one over on you. Good card to play.
I really think that the banks know that most people don't read the fine print and don't understand how the bank works and they squeeze in those fees that really don't need to be there. Customer doesn't know any better so they figure it was their fault.
I also keep in mind that all of this stuff is run by computers and often the programs are not perfect - not saying that the bank isn't sneaky with the fees but sometimes stuff does get screwed up on the technical side. Now if they would hire awesome programmers like me they wouldn't have these problems. Hee hee!
I know I have complained about fees at some banks in the past and sometimes they took it off but sometimes it was my own stupid fault too.
Now, if only we could do this with our credit card companies.....hmmm."I broke, I broke, it's off to Chapter 7 I go"
