    Still NO STOP PAYROLL DEDUCT ORDER!

    My chapter 13 was converted to a chapter 7 on 4-3-09 and I have not yet recieved a stop payroll order from the court .How long does it take and how long will it take to get a refund for the payments they take since 4-3-09 I filed in Akron, Ohio

      It took 30 days for a stop payroll order for me. And it didn't go to my payroll department, just to me, so I had to take the paperwork in to my business office myself, otherwise they'd still be taking it out. But this was just for a 3-month suspension of payment, not for a conversion. I am in Ohio though in the Southern District. Lawyer said it'd take at least a month because the judge has a mandatory 20-day wait after notifying creditors of the change, and only if no objection is made in that 20-day do they make the order.

      Plan Modified July 8, 2009 from $1100/month to $400/month due to change in income, finally discharged in July of 2013!

        Oh I see I'm in the northern district of Ohio i work for the Government so hopefully they will send it to my payroll dept. Any Idea on how they do the refunds on all payments taken since the conversion date?? thanks

          If you filed with a lawyer, then he/she will likely know how long the stop payroll deduct order typically takes to activate in your local court.

          If you didn't file with a lawyer, you can call the bk court and politely ask the clerk where the stop order is currently in the process.

          We can throw darts at a dartboard taking guesses about how long this might take in your situation, but it's just guessing....not very helpful, I'm afraid. Sorry.
