I know the income goes by the last 6 months before filing BUT

What if I had been making 40K a year then and I get a new job that is more like 60K a year a few months before filing~ is that something that can hurt my case? We'd still be under the means at that point.

And another question~ when they mean 'persons in household' do they mean working people or do they include kids in that figure to find out your allowable income?

Person's in household is ALL persons in household, working or not!

If you are still under the median income for your state even with the increase in income, it will not hurt your case.
    Filed CH 7 9/30/2008
    Discharged Jan 5, 2009! Closed Jan 18, 2009

I am not an attorney. None of my advice is legal advice in any way..

It may not automatically hurt your case, but you have a good reason to be concerned.
      You should consult your attorney.
Because of my wife's low income, we were looking good for the means test.
But she got a better job towards the end of our 6 months, and our attorney recommended we file a month earlier than we had planned, to keep her overall 6 month income lower.
Fortunately, because of my procrastination, we were goingto file after 7 months of no cc use, so we ended up filing a month early, at the 6 month mark.

        Consult your attorney

When we had our consult, we were told that even if we were under the median, if our future ability could support a 13, then we might be pushed into that. They can basically do the means test on you even if you are under the median.
