Case closed!!!!!!!!!!!!!!

For those of you who may remember, I was discharged from my chapter 7 business case on February 13, 2009. Although I was very excited, I was still concerned the trustee would my tax return from 2008 because I got a decent amount due to a loss on my business. Well, my case is officially closed ODAY!!!! I looked on PACER and there it was - CLOSED!!!!!!

I guess I am keeping my tax return and I truly have a fresh start. I think a celebration is in order. A weight has been lifted off my shoulders and I can smile again. Thank you to all of you on this forum. You all are an inspiration. There is no way I would have gotten through this without your support.

For those just beginning this journey, use the wonderful people on this forum to vent and run things by. You will get unbiased advice from people who truly care. It may not be the news you want to hear, however it will be the truth which is what you need in a bankruptcy. Hang in there as it will end soon!!!

i will likely run into the same issue iwth my 09 tax return. We will be adjusting withholdings so that we do not get too much back at end of year (Plus we wont have mortgage interest write off that we usually do for 12 months...this yr only 3 months)

So my question is...you were discharged in FEB but they left your case open until NOW? What went on in the meantime with trustee? Did he watch your every move, every expense, every income? Do they have right to do that? And did youa lready get tax return, and thent he case was closed? Or did the trustee contact you telling you they were no longer interested in the return? How much of a return (if you dont mind me asking) were you looking at here?

I ask because I get the child tax credit ( I have 3 children and will have 4 with the birth of our newest in May 09) SO I assume that will show on refund, no?

Im just trying to get an idea of what I'll be up against. Congrats on your relief, and thanks for sticking around to help

Afraid, the reason my case was open for a bit after discharge is because I was surrending several rental properties in the BK. Several of the lenders filed relief of stay motions and the hearings were scheduled after the discharge date. The lenders didn't notice that I was discharged so they left the hearing dates scheduled. Because there were hearings pending before the court, it was unable to officially close.

The hearings were taken care of and a few days after that (being today) I looked on PACER and saw it was closed. I was extremely fortunate.

My 341 was in November 2008. The trustee asked about my refund and wanted to know how much I expected. I told her and she didn't say anything else. That same day she filed her no asset report which was a pleasant shock to me. I had to do an amendment after the 341 for some extra assets that I forgot about when I first filled out my paperwork. My attorney was awesome and correctly told me to do the amendment versus leaving it and hoping the trustee did not find out. I expected to hear from the trustee after the amendment. The amendment was filed and nothing from the trustee.
