I've not posted much on here lately but thought I would let everyone know how our 341 meeting went on last Friday.
Our meeting wasn't until 5:00 pm and we got there at about 4:00. Soon after 5:00 they called all of the 5:00 meetings into the room where they had the first case already seated. Ford Motor Credit and a local bank both showed up for hers and I got so nervous - I think you could literally see my heart pounding in my chest! All they asked though was were the vehicles fully insured, insurance carrier and was she going to keep making payments.
Next case, pretty simple. No big deal then we were next.
The trustee was really nice though. He had several questions about my husband's motorcycles, asked if we were going to keep our trucks, and surrender motorhome still. He asked if my husband owned any construction equipment when he had his business (he didn't) and asked about my stock.
I was so nervous that they were going to ask about the large credit card debt or question our vehicles but he didn't.
GMAC and the motorcycle lender had not done their part in sending over an interest in the property and asked our attorney to check over her exemptions for my stock and our house as they were both listed as exempt. I think once they adjust the figure for FMV of our house we should be more than okay. He did not issue a continuance and said just forward the titles from GMAC and the other company when received.
We live right on the border of two states and filed across the state line to try to minimize public knowledge of our filing. I think it worked out okay as the trustee was not as familiar obviously with our state's exemptions. He seemed to be pretty easy going and was joking around with some of the attorneys and the guys from Ford and the bank before we started.
The court system's computer program automatically set appointments and before anyone caught it had set 341 meetings all day on Good Friday and had them until 6 or 7 at night! I think our trustee was really just ready to go home and joked about it at the beginning.
Now just waiting on our 60 days hopefully!
