    make partial mortgage pmts after NOD?

    My 2nd mortgage is the only one hounding me, and the only one who sent what I think is the NOD. Not sent certified mail, though...is this just a scare tactic? If I was to pay part of what I owe from the second would it stall foreclosure?

    OR If I was to get current on only the second mortgage (still missing on the 1st mortgage, they just haven't contacted me yet) will that delay foreclosure?

    I have both mortgages with Chase in Nevada..need to stay in home as long as possible.

    ALS, I checked county website and it doesn't like like any NOD was field yet...how soon does that post after I get the NOD.... and don't I have to get an NOD from both loans?

    I'm just so confused about how two loans work...could they foreclose on one, and then I still own the home since my name is on the deed with the first? UGH this is mind boggling - I wonder if my missing the 2 mortgage payments in different months complicated things.

    (I missed the 2nd mortgage pmt since Feb and the first mortgage pmt since Mar) WHAT TO DO? Planning to file BK in July
    waiting to file in july-august,
    waiting for Chase to begin foreclosure,
    waiting for cc's to begin lawsuits,
    just waiting (& "afraid")...

    I think your okay. Usually the 1st loan will foreclose on you before the second loan because the 1st loan is bigger. Since Chase is the same in both then it really doesn't matter. My buddy has Chase and is 2-3 months behind. Initially, they threatened him etc, but when he said he was leaving, they changed tunes and wanted to "work things out." He told them to pound sand. Anyways, I believe 90 days out is when you received the official NOD. Go check out other sites like loansafe.com. They have a Chase section. I don't know what your intentions are but you might be able to stall a bit by doing a loan mod or pretending to do it etc. Ethical or not, most loan mods fail within 1st 6 months.

    At this point if you aren't staying I would pay anything. And unless the Sheriff is knocking on your door for eviction I think you're okay. In CA I've actually heard of people having to go to court to get people evicted from foreclosed homes, go figure.

      If you are giving your home up in the BK - do NOT pay a dime toward either the first or the second. It takes quite a while to actually foreclose now because of the volumn. I don't know your exact timeline because you are in Nevada. Here in Fl the 'normal' timeline is 6 months - but because of the volumn we are running 12 to 18 months. Check your states timeline -I know Nevada is just as bad as Florida! So work that to you advantage.

      By the way, getting current on the second will not help you at all to delay the foreclosure. The BK will delay it.

      You will NOT own the home once the foreclosure is completed. That is the defination of foreclosure - the bank takes ownership of the home and wipes out the jr liens. You are so close to filing, just ignore all the collection attempts - and file in July like you have already planned.

        My first mortgage is with Chase and my home is in NV. I'm about 3 months behind. Once you get the NOD you have 120 days I think.

          Is that the timeline posted on various websites? Ask your attorney for the 'real' timeline now that the courts are packed with F/C's.
