Help needed - 2004 Examination and Adversary Proceeding

    Question:

    am I out of time to file given that I fly out tomorrow 5/26? I believe that it would be difficult if not impossible.

    Could I have a lawyer file AP electronically on my behalf or do they have to mail forms to court? You could but you'd have to sign the paperwork to be filed.

    Can a motion be filed to extend time for AP or time to conduct 2004 Examination? I do not believe their is a motion of extension for this, however I'm not a lawyer and one might possibly know a way I don't know.

    Can I do any of this without a lawayer - at least the motion or AP filings to save time e.g. tomorrow morning be at the court early and file the forms. You could do a Pro Se filing, however I have no idea what forms you would need to use or how you would do so, I'm also not sure a pro se filing of it would be successful ultimately.

    If you have evidence that they are still operating the business then by all means I'd notify the trustee and UST, and send what evidence you have. However it is up to them whether they determine it to be sufficient to investigate.

      Just a curious question.

      But can't the Trustee ask for an extention of time for creditor objections?

      I thought I had read of this happening before?

      Perhaps if the TT was notified and a suggestion placed into their head , and given that it is possible to extend, then perpaps talking to the TT about extending the time for objections may be prudent?


      Just throwin' stuff out there, I could be way off!

        It could help dingdong I don't know, mentioning the car accident and asking for an extension of time might work but I don't know the legalities of it

          It's not impossible for extensions to be done. We have plenty of members on this board that have been on the opposite side of it.

          The health issues the OP has been through may be good enough reason, but again he would need to have a lawyer already lined up to do this. Hopefully he at least sent the info to the UST but it seems like it may already be too late.

          Only an attorney could hope to answer your questions.
