    Another one about household income

I'm going to file BK at the beginning of next year. I've been told that my fiance (who is a student and has no income) will be included in my household. This is helpful because I'm just over the median income for a single person household but way under a two person household.

My question is... what will the trustee need to see from him?

It depends largely if you'll be married or not by that time.

If he does get a job before then then anything made in the 6 months prior to filing will be used on the means test towards household income.

Otherwise probably nothing is needed other than proof he lives at your address.

      Thanks JRScott,

He won't have any income until June/July 2010 and I'm planning on filing around Feb/March 2010. We want to get married this summer but we're waiting because of this whole financial mess I'm in. Would getting married help or hurt the BK?

He has no income and no assets, just a whole bunch of student debt.

Most bk lawyers will advise you that it's usually best to file bk first then get married. This is particularly true if you live in one of the community property states.
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
