    Motion For Relief

    Love the board. Quickly, we filed no asset chapter 7 on 2/23 and the trustee filed "No Distribution" on 3/31. We are surrendering an upside down car. Looked on Pacer and seen that the Bank who has the loan has filed for "Relief of Stay" and the court date is 5/6. As I said we are surrendering but I am looking for some sort of time line for them to come and get it. Any idea of about when they may come after it? Just wondered if they come and get it on that date or 30 days from that 5/6 date, or when. I know there is no exact answer but wanted to get an idea so we could plan on new transportation.

    Secondly, about a year ago, we were in a parking lot at a mall in a neighboring state. Someone sideswiped the car and placed a big old scratch on the side of the bumper. Will the Bank come after us over this? Will they go after my insurance company? We didnt realize it had happened until we were home so we didnt call the police or get it fixed. Just looking for some insight. Thanks in advance.

    Since its included in the bk no they won't come after you, though you should have reported it.

    They can't actually take the car until the court grants the motion Relief of Stay. Once that is granted....a mere formality since you are surrendering they will probably come get it the week after.

    July 2nd, 2007: 341 Meeting Held
    September 4th, 2007: Discharged and Closed.
