    Our 341 meeting is next Tuesday....

    ...and we have not received any requests from the Trustee for bank statements, tax returns, anything. There is nothing in PACER except that our mortgage lender has filed for relief from the automatic stay so they can foreclose.

    If the trustee doesn't ask for anything, should we bring anything? Should we still bring our bank statement showing balance on date of filing plus our last two years' tax returns, just to be safe, or should we bring nothing since he hasn't asked for anything??

    Did you use an attorney when you filed? Ask your attorney what is custom in your district. The districts vary widely on the requirements.

      No attorney -- we filed pro se because I have a legal background and felt confident that I could do it properly.

      The only problem so far with it is that issues like this come up, and I have no one to ask.

        I would bring bank statments,and tax returns.Our trustee asked to see it all,one person in front of us did not have it and he yelled at them and was not happy made them come back in a month

          You absolutely must bring a government-issued picture ID and your Social Security cards with you. Otherwise, if you are missing something, the trustee will just continue your 341 so you can provide them later at a rescheduled continuance.

          Another option is since you are a pro se filer, call the bk court clerk and ask politely what to bring with you.

            I recommend being safe and bringing everything you can think of, including 6 months pay stubs, 3 yrs taxes, 6 months bank statements including the day you filed.

            I brought a big pile of stuff, but I wasn't asked for any of it. I'm glad I brought it just in case.

              Thank you all, I will be bringing all of the above! We don't want to take the chance of being continued, so we'll bring it all.
