    Hearing in about an hour

    Finally, our court day has arrived.
    Lots of butterflies in the stomach.
    We're going chapter 7, reaffirming the house and 2 cars, and trying to get out of 60k in CC debt.
    So nervous, partly about the unexpected today, and then there's the 60 days after.

    I am considering in reaffirming my house as well. Did you have to do a loan mod on it or are you planning on doing a loan mod. I'm months behind on my mortgage.
    Retained attorney 4/21/2009 Monday
    Filed Ch 7, 4/30/2009 No Asset case, Under median.
    341 Meeting 6/9/2009 - went well.
    Discharged 8/9/2009, Closed 8/11/2009

        We're current on our home and car payments, and have great interest rates, so we don't plan on a loan mod.
        Of course, we stayed current through some unemployment and the economy issues (gas prices, etc), by using our CC's.
        We've adjusted our spending, and the wife has a better job.
        We will still need things to go our way, but as long as we keep our current jobs, and lose the CC debt, we will be okay.

          good to hear that. I'm underwater, and my mortgage is supposed to readjust big time in 2010. I have to loans. I seriously need a loan mod in order to make it even after I get discharged. Some people on the forum said not to reaffirm what was the advantage of reaffirming for you?

              Hearing was simple.
              We waited our turn in a warm room, then went up when called.
              We were sworn in, verified our name and address, and asked a couple of questions;
              What our house was worth and what we owed,if we had filed and received a tax refund, and if we were expecting money from a lawsuit.
              Then she asked if there were any creditors in the room that wanted to question us, which there weren't, and then we were done.
              About 10 minutes.

              Now we have 45 days to do the post filing credit counseling....and then wait 60 days and try not to let our nerves get the best of us.

                You must be so relieved now!!! I think the thing I am scared the most about is the 341 meeting. I have a feeling I am going to break down and cry in front of everyone. Maybe having a drink (or 3) will help??? ;)

                    I agree with Logan, get it done and get the certificate and file with the court! Make sure your attorney files that certificate on time.

                      congrats....I get sick just thinking about going to mine..which wont be for awhile, since Im not filing yet. Just thinking of getting that over with makes me smile.. Good for you.

                        Oh I intend to do it by the end of the week, online.
                        And after re-reading my last post I want to clarify, I have 45 days to complete and file that, and the 60 days runs concurrent, not 45 days and then another 60.
