    Ok my attorney says that I am offically discharged and that they called the Bk courts and that this has nothing to do with me. She says its the UST that is going after the creditor. I asked her then why do they want to extend my closing on the BK and she says it because it costs them money to re-open a case. But, she says it has nothing to do with my discharge. I find that hard to believe cause why pick on my BK. If they are going after a creditor why would it be put on my BK? In the subject line it says re: and then my and hubby names. I am so damn confused!

    But it does says discharged. It sucks casue I felt like its bittersweet! I really cannot enjoy the discharge because its not going to closed until july and if it has nothing to do with us then why the extension?

    Can they file for a discovery a day after it is discharged?? The file and docketed date is both today.

      Unless they filed an AP before the 60 days or date of discharge, I think you have them beat.

      A guru will hopefully chime in.

      Hopefully that discharge order came just in the nick of time and you are done.

      Yes, I am a no-asset case.

      B65 - I just noticed the discharge this morning when I went on, I was like YEAH BABY!!! and then I see the motion for a discovery!! So now I am confused and upset.

        Did you possibly have a preferntial payment to one of your creditors? Maybe the UST is trying to get some money back to disctribute to the other creditors.


        Just enjoy that discharge for now. Looks like you are done, let the UST mess with your creditors all they want, you are debt free girlie!!

          you ARE DISCHARGED!!!!!!!!!!!!!!!!!!!!!!.

          The wording can be funny on things....You know what i think it is... the UST going after the people that took your boat.... it has nothing to do with you anymore... you are discharged.... it is over..... it is done!!!!!!!!!! your attorney told you it is nothing to do with you..just something that came up from your case and it sound slike the boat thing.... You are done, those debts are gone!!!!!

          CONGRATS!!!!!!!!!!!!!!!!!!!! this has been a good week... for you and me!! My taxes are going in my account friday morning, and rememeber hubbys beat up car? i called USAA and told them that they had been taking money out of my account since the end of OCT and they had violated the stay... they put $500 in my account today!!!! i told you it would all come good

          I am so thrilled for you!!!!

              Hey! Maybe the UST is going to file sanctions for you against the boat takers and issue you a big check!

              I know that is highly improbable , but wouldn't that be the kicker!, the guy that caused you the most grief in your filing, issuing a check for stay violations and damages after your BK is over.

              One can only dream! ( and I know that isn't whats happening but wouldn't that be sweet justice!)

                    Congrats Jessegirl...don't you dare go anywhere!!! I might need your support down the road...I saw someone walking around my home appraising it today...could be the county, could be the trustee, could be a creditor...but it's so far upside down, it's not like it could be taken.

                      Congratulations jessegirl, on your discharge!

                      I have read several local cases in which the US Trustee kept the cases open so that they could pursue a specific creditor, eCast Settlement, for sanctions and damages. Sometimes the Trustee gets fed up with a particular creditor, and goes after them as part of several cases (as I've seen).

                      FYI, eCast Settlement is one of the worse offenders of the rules, and my Judge raked them over the coals on a suo sponte show/cause hearing. I wouldn't put it past the US Trustee that they are doing something similar, and if your lawyer says don't worry, then don't worry.

                          No dingdong - I didn't make any preferntial payments. I did google the trial attorneys name and he is a trial attorney for the UST offices. Now what the heck is this about? My attorney said it had nothing to do with me but in the subject line it says - RE: our names: This sucks cause I want to celebrate so bad that it is finally the end, but now I am alittle scared. If the courts told my attorney it had nothing to do with me then why is our names in the subject line?

                            It sounds to me like you are discharged. Yahoo! Your situation gives me hope for my case, which is currently in limbo. What a nightmare but I think you are in the clear. So happy for you. Stay in touch!

                              I think your in the subject line

                              because the UST is going after a creditor who was involved in your case, hence your name in the subject line... it has nothing to do with your or your dishcharge, the UST saw a creditor breaking rules and is going after them, you just wave buhbyeee and smile and say...dont let the door hit ya...
