    Reaffirm Agreement Issues (Help)

I have recently filed my reaffirmation agreement with the courts. My payments are $445.00 a month.. I have never been late an I current up to date on my car. The are only 4 years left on the life of the loan. What are the chances that the judge will order a repo? My job is stable, even with the hard times right. I never hard a problem paying my car payments, just the credit cards. Not to sure what I should do???? This is really stressing me.....don't have the $$$$ right now to buy a new card..

    Filed 02.15.2009
    341 Meeting 03.25.2009 No Assets

You have the opportunity to explain how plan to keep pay for your vehicle. Some judges will make you come in front of them to explain. My attorneys office said that a new judge was taking over cases and wanted explanations. I wrote, I have never missed or been late on either of my vehicles and home. I also put some numbers on how I planned to pay for it. example.. gas dropped in half since my filing... This freed up $200.00 to make payments. Judged signed off on my last reaffirm last week.

      MiBankruptcy,
Did you show a negative budget and the judge still allowed you to keep the car? Is this why he asked for an explanation? I'm hoping to keep mine even if our budget shows negative and was wondering if we were going to get help from a relative or if I had plans to get a part-time job after discharge if he/she would be lenient b/c of this...

We were in the negative and the judge decided that keeping my car was an undue hardship. We are just doing a ride-through now.
        Chapter 7 filed 10/21/2008
        341 - 11/26 went smooth NO ASSET
Took 115 days after 341 - But Finally DISCHARGED 3/25/09

          Yes,
However, our attorney or legal aid said this was a new judge and he was having people explain how they would pay for it. They typically would just put a new statement and stating we could pay for it.

What happens when gas prices go back up?

we have two car pmts that total about 800 dollars a month...want to keep both but am afraid jude will think we dont have enough income....(41k year) SO

If my husband has been promised a new job in August/Sept and we file in July, will the judge see this and say its okay? The new job will not provide enough of a raise to change our means test passing (we have four children and low income)

Will they let us eep cars, should we just do a ride through from the start?

HOW DO YOU DO A RIDE THROUGH? ARe attorneys generally willing to do so?
              THanks!
              waiting to file in july-august,
waiting for Chase to begin foreclosure,
waiting for cc's to begin lawsuits,
              just waiting (& "afraid")...

TEW, You've asked me a couple times and even suggested I may have lied on my forms. Since, I exempted my tax return I will pay off one of my vehicles. Thus, leaving me enough to cover my a$$
