    Previous Years tax returns

    How many previous years tax returns were needed? The attroney we saw, in his paperwork he has me getting the last 4 years. Another attroney online in the information he has says 2.

    The reason I ask is this. The 2005 return which would be the last of the 4 years was filed jointly with my ex husband in another state. It is a community property state and I had a name change in the divorce decree. So if I have to use that one also it brings up all this old stuff. The income in that return was all my ex's because I didn't work.

    I am just feeling overwhelmed in paperwork right now and I don't know if I will ever get it all done. I have a small business to keep up with so I just get whats needed and have to had more for the week I just finished with work.

    My attorney also asked for 4 yrs. When you submit the tax return copy for 2005 you can attach a note to your attorney that you were previously married etc.

      Do you think I should include a copy of my divorce decree that has the debt division and name change in it.

        That is a good idea. If the Trustee asks your attorney for it then he has it to send promptly to the Trustee.

          On your statement of financial affairs, you need to list any marriages in the last 8 years that were in community property states.

          As for the tax returns, it is really up to the trustee. You are required to send the trustee your most recent tax return at least 7 days before your 341. The trustee can also send you (or your attorney) a letter requesting more tax returns. In my case, the trustee asked me to bring 2 more years to the 341, but he never even looked at them. He didn't look at any of the extra info he requested me to bring.

            This attroney asked how long ago my divorce was, I told him April 2006. He didn't ask where and in the form about previous spouses in commumity property states he put that I didn't have to fill that out.

            I wondered about this and I am assuming I have to have it. I am going to try one more time to send him an email. If he doesn't want to answer me back I am not sure I am going to use him.

            I also am wondering about life insurance. Again I live in Iowa if that makes a difference. I have one ordinary life and one variable life policy. The last I knew I had used all the loan value on them. I see now there might be a little more available.

            Will the trustee make me use that money? I don't see how they could make me go further into debt on my life insurance loans but then I don't know the laws and rules.

              At my 341 yesterday, the Trustee was asking for 2007 and asking if you had filed for 2008 and, if so, do you have any refund coming. - jb
