Trustee always take what is in bank account?

Filed for chapter7 two days ago!

At the time of filing, there was $500 in our bank account. There really wasn't much we could do about it, but it was there. Does the trustee ALWAYS claim that money? Or do some just say, "heck, that's not worth claiming" and leave it alone?

when we went in they told us it had to be below a certin amount we had 250 and they said it was 25 dollers over but it was to little to worry about

we got keep our cash in the bank and our 08 tax return! He was in a good mood that day

I had $1100 in bank day of filing b/c my attorney filed me on my payday and I have direct deposit. The trustee never even asked to see my bank stmt.

Depends on your situation but if you are simple no asset case, no one is going to want your 500 bucks.

People make way too much out of the having "less than" amount in the checking account the day of filing but to safeguard one can always include that amount in the exemptions....again assuming a simple no asset.
