    Confused about gifts I could receive...

    Can friends and family flat out give me cash to cover expenses and pop for the lawyer prior to filing? How long before filing? How do I disclose the gifts in the BK Docs?

    I just got laid off my job and to survive I may have to accept gifts. What if they give the money to my husband who is NOT filing?

    I don't want to hide anything. I just want to know how to correctly account for it.
    Scared to file. Scared not to file.

    Having friends or family pay attorneys fees is no problem.

    However, in the big picture, if you need gifts to get by, you shouldn't really file BK until your finances have stabilized. That doesn't mean you should not go out and hire an attorney, but realize that any attorney that is worth hiring will not file your case until you have at least enough income coming in to pay your expenses (meaning, income you and your husband generate).

      That is another good way of looking at it. I don't want to wait until I have judgments to file though. Thank you for your response.

        Right now my Mom is helping with my rent. I wouldnt think that was a problem with BK tho. I dont think the Trustee cares if my Mom gives me some money every month, does he/she?
        I was wondering tho if that counts as income???
