Will my Ch7 affect dad who cosigned on FSL?

I know student loans are not dischargable in BK, but are they totally unaffected then by my filing BK? I just realized my dad cosigned for one of the two I have, I need to know if his credit would be negatively impacted by my filing?

My guess is no....am I right??

You are filing bk, not your dad. His credit should not be impacted.

However, rarely one or more of the credit agencies makes an error and puts the bk on the non-filer's credit report as well. (This happened to our son who was a co-signer on one of our cars when we filed Ch 13.)

Have your dad monitor his credt reports a few times during the first year after you file. If the bk does show up on the student loans on his credit reports, all he has to do is dispute it and it will be removed. That's what our son did - the incorrect bk coding on his credit report was gone in a few days and has never returned.
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
