Is 341 Meeting to be 30 days after filing?

    Is 341 Meeting to be 30 days after filing?

    Hello - I apologize if this was already asked, but I though that the 341 Meeting was to be held within 30 days of filing your petition. Mine was filed yesterday, 3/31/09 and my 341 meeting is scheduled for June 12. And the 60 days to discharge...is that from the date of filing or the 341 meeting?

    Thanks so much and I really value this site - it's been a huge help!

    I believe it is from 341 but I am mnot sure. I think the number is somewhat arbitrary. I was told to expect discharge in 60-90 days from the 341. As it stands, it is scheduled 45 days after the 341 (discharge is) and my filing date is about 5 weeks before the 341.

      Usualy the 341 is held 4-6 weeks after filing. Perhaps your district is extremely busy or a Trustee is going on vacation?

      Don't know what to tell you.

      The last day for objections to discharge is 60 days after your first scheduled 341 ( if you happen to be rescheduled)

      Discharge can take anywhere from 61 days to who knows-another poster here had to wait over a year for discharge. So it can really vary by district and what is going on with your case.

        Ours was about 30 days after we filed. Did you use an attorney? If so, I'd ask them about it. There's a possibility that the district you filed in is really backed up too.
        Filed C7: 12/16/08; 341 Meeting: 1/22/09
        Last Day for Objections: 3/23/09 (No Objections)
        Discharged: 4/3/09
        Closed: 3/23/10

          It is normally held 30-45 days after filing with discharge 60 days thereafter. Unfortunately the court system is overloaded . As such it is not unusual to see longer times to the 341 in especially busy areas. Most likely with such a late 341 there will be an extension of the case for 60 days by the trustee such that you should discharge sometime in August.
          May 31st, 2007: Petition Filed by my lawyer
          July 2nd, 2007: 341 Meeting Held
          September 4th, 2007: Discharged and Closed.

            Thanks for all of your answers...puts my mind at ease. I wasn't sure if it was a hard and fast rule that the 341 meeting MUST be within 30 days. I'm sure the bankruptcy courts are inundated with petitions.

              My district--Southern Ohio - Dayton is running about 60 days from time of filing to 341 meeting. They are pretty backlogged right now.
