    Overtime after filing

    What if you got somewhat steady overtime after filing BK? My husband is currently working after being laid off for three months, we are in the process of filing but he believes he might be getting some overtime coming up this summer. currently he brings in about $4500 net pay (take home). If he was to start overtime a month after filing would the trustee want that money?

      tew: its a 6 month lookback from the time that you file? That figure has to fall under the means test correct? What about when you go to the 341 meeting and they ask you if your income has changed, is the trustee referring to base income and or overtime income?

        Income is income.

        But, taking the overtime is fine after filing. Also, by the time you get the income from OT, chances are you will have already had the 341 meeting.

        The OT is not definite, so just say no.
