    Ch 7 Filed Today What about Garnishment hearing?

    We have a garnishment hearing next Mon...BK was filed today THANK GOD!!! I know it is an automatic stay and they can not garnish but do we have to go to the hearing or just call the court and give them the case#? Thanks

    I would just call and ask the court. I would think it stops everything.

    We filed and a couple days later get the papers that we had a judgement. Our attorney said it stops everything. We though didn't have a date to appear.

      I believe that your attorney and the filing would be sufficient. By courtesy only, you might call and give your case number. You should not have to attend. 'Hub

          I would make absolutely certain that the court had the bankruptcy case number. I still think I'd show up to insure that something didn't slip through and that garnishment get granted. It is harder to get the money back after it is taken than to stop it before it is even granted.

            his work we will notify as well to make sure it does not go through!! they are laying off anyway 300 again by fri so he might not have ajob anyway...just like everyone else.

              I did call them they just need the Filing Notice and I said as soon as I get it I will submit it, but I also wrote the judge and gave case# and attys name etc. I called the attys office and told them to notify the creditor. So, we will see, but I am not going to court that day... that is a waste of my time. I will make sure everything gets submitted and handled before then. My hubby is getting laid off so either way they are not going to collect, in our state unemployment is exempt from garnishment and he pays child support so there will be nothing to garnish.
