    BK for the second time- Anyone done this?

    In talking about my situation with a friend they mentioned that they too were going to file, but this will be their second time doing so. I noticed that in the list someone gave of the questions that trustees will ask at the 341 mtg that there was one there that asked if you had filed bk before.
    What happens to you if this is your second bankruptcy?
    Do they scrutinize you more closely?
    Any advice to give my friend?

    It's my second time, and I had to wait 8 years past the first file date. I haven't had my 341 yet but my lawyer doesn't think it will be any problem.

      Yea, I believe its 8 years between 2 Ch 7's, and 4 years between a Ch 7 and 13.

        My second time as well. If it's been over eight years, it's pretty irrelevant, from what I understand. Mine was almost nine years ago, and my lawyer isn't the least bit worried

          It shouldn't matter - the law says that you can file again after a certain amount of time has past. They should be fine. My friend filed 2 times and the trustee asked if she ever filed before she said yes and that was it. She is now discharged and closed for the 2nd time..

              No none. They jut asked have you ever filed a BK before, she said yes and that was it. She is discharged and closed for the 2nd time.

                I have filed twice, almost exactly 8 years in between (8 yrs. 1 month). The trustee asked me if I had filed before and when I answered and he said "And you just happened to file again exactly 8 years later?" I just said that's how things turned out. I thought maybe he would scrutinize things closer due to that statement, but he didn't. Everything went smoothly and I was discharged without any problems.
