My chapter 7 was discharged on February 13. I had to surrender numerous rental properties in the BK.
A few of the lenders filed a motion of relief from the automatic stay while in the 60 day club.
To my utter surprise, a couple of the lenders filed motions for relief of stays after the discharge. Is this necessary? Once I am discharged aren't they now allowed to move forward in the foreclosure process?
Why would they do this if there is no need? No wonder the banks are stuggling. They are wasting money on lawyer fees for no apparant reason.
It wouldn't bother me at all except it is holding up the closing of my BK.
Although the discharge is what I want, I will feel completely relieved when it is 100% final at closing.
