    Discharged and a collection call on the same day

    Today we saw our Discharge papers on the web.... but I also received a call from BOA for a breach of contract...? I checked the papers and saw that the attorney posted CHEX SYSTEMS as a notice in our debts - not specifically BOA...

    I sent an email to my attorney - waiting for a reply....

    Has anyone seen this? I am assuming I will have to pay it.....

    Don't get out your checkbook yet. Did BoA get a notice? Is Chex Systems who you believed owned the debt?

      I wouldn't pay it yet, I'd wait and see what your lawyer says.
      May 31st, 2007: Petition Filed by my lawyer
      July 2nd, 2007: 341 Meeting Held
      September 4th, 2007: Discharged and Closed.

        Chexsystems is a reporting agency for returned NSF's or overdrafts. This is a database banks check for any sort of overdraft. A check or debit is reported if not paid within a certain time period.

        Normally the debt is reported to Chexsystems, but not owed to them. It is either owed to the OC (in this case BOA) or a collections agency.

        The BK wipes out the debt if it was before your filing. As the others said, check with your attorney first.

          Are you asset or no asset? It may make a difference.


          If no asset, some districts assume all dischargable debt prior to filing is discharged, even w/o notice or having the debt scheduled as their are no assets to dsitribute and no proof of claim is needed.

          The logic is , why reopen a case to amend when there was nothing to pay out and take up the courts time?
