    expenses and savings immediately after filing

    I am confused about a couple of things. I just filed my chapter 7 bankruptcy. I am letting my house go and not reafirming. My question is, the trustee will take 25% of what I have in the account the day I file, but how about afterwards? I will continue to recieve paychecks and am not going to be making a house payment but will continue living there for atleast a couple of months. What happens to that cash? Is it still the trustees until i am discharged? What about spending? How closey is that monitored after filing?

    The money you make after filing is yours. You are not monitored after filing - you may need to provide your bank statement at your 341 showing your balance as of the filing date

      So if you file on March 14th when would your 341 meeting be? I find it funny that you can have $10 in your name right before you file and then get paid $1000 the very next day and keep it. Why do they allow us to manipulate the system like this?

        Remember the filing date is a snapshot in time. It is not manipulation - it is BK planning. There is a difference.

        Depending upon how busy your district is, your 341 is about 3 to 6 weeks after your filing date. Mine was 34 days after filing.

          In my book, planning = manipulation. When you can control it through planning, you're manipulating everything to work in your favor. I'm all for this but to me, it almost sounds like a loop hole. You'd think that these people should be taking all of your money until the final day of discharge. It's so nice of them to be nice and let us keep the money after the date of filing. In a way it just sounds too easy.

          I am just praying that I will have a large sum of cash saved up after I am filed and discharged. I want to NOT re-affirm my car and drive it for several months afterward and then GIVE THAT PUPPY BACK and buy a nice used car.

          I found a beautiful 2006 Nissan Sentra for $6,000 and a nice 2005 Nissan Altima for $6,000 as well on Auto Trader. These cars would suit my purpose just fine.
