    Has anybody heard of this

    Met with a lawyer and was confused. We told him we were going to wait because we didnt have the money to retain him yet. He told me that he accepted CC as a way to pay him to file my BK????? He told me just stop paying and we would just wait 3 months to file

    Has anyone ever done this? Is this true??????

    Yikes! That kind of arrangement would make me really nervous. I think someone else posted here that an attorney made them the same offer and most of the replies were on the order of RUN and find a new attorney!

      It sounds like the atty is wanting your business and is putting that want ahead of your concerns and issues.

      I would be very leary of such a deal. It seems that it could somehow come back to you.

      Are there other attys in your area that you can get a consult with.
      I know our atty deals in cash only and like many others we are waiting to have the money to retain him. He requires $300 down(filing fee) and then the rest with in 2-3 weeks.

        Various attorney's have different fee structures. If you are filing a Ch 7 most will allow a small retainer up front with the balance paid in installments. The petition is not filed until you have paid in full.

        Having said that, the idea of charging on a credit card to pay the BK attorney fee is wrong. Do not do it. Find another attorney.

          That is a bad idea. Technically, you can get away with it, but any BK attorney worth hiring would not accept credit cards.

            That lawyer is a crook and a very bad example. It brings down all other lawyers who are in rare circumstances, honest. He is aiding and abetting fraud, as he knows that is an unsecured debt and will be discharged. Even though we are bankrupted, we have ethics and honesty, (call it character) and would never deal with this type of person. 'Hub

                i probably should have tried to file before i blew through my savings after cut hours at work, but i was trying to do the right thing. I know these are my bills that i made and want to pay them. but i am at the point were it is the cc's or my mortgage. Mortgage wins.

                This guy made me even more nervous. can anyone help with some good questions to ask the next lawyer i see? what should i look for? i want to pick a good oneThanks

                  There are a couple of threads on that very question, so do a search.

                  Make sure to ask if the ATTORNEY you are hiring is going to the 341 and not some jr attorney.

                  There are more questions....but that is a biggie...
