Ok, this is a longgg story but can anyone answer this? I had a moped that I purchased several years ago. It's been paid off long ago. I am listed as a no-asset case. I was looking through papers, and noticed that the title still has my old bank as the lien holder. I never received the lien release when it was paid off. Sooooo, now I am going through Ch7, in fact DAY 60 is the day after tomorrow. I have discharged some debt with this same bank in my BK. If I call the bank to get the lien release for this moped, can they block it? Even though I paid it off long before I ever filed BK? Thanks for anyone's thoughts....

They shouldn't be able to.

If you paid it off years ago you might could just get a new title as they abandoned it on your property....depends on your state laws.

Thanks JR - I was thinking the same thing after I thought about it some more... .going to try that today. Day 60 tomorrow!

I had a similar thing with my camper. I went down to the bank and had them sign the release or title. They just looked up to see if I owed them for the camper. Shouldn't be a problem

You may also be able to go in to the DMV and apply for a title. They contact the lien holder to see if it is released and mail you the title. Depends how your state handles it.

Ok, well I called the DMV this morning, and they still show the lien on it, grrr... so I called the Credit Union I had the loan through, and after she saw that my account is "flagged", she could not help me and I have to speak to someone else who is not at work today. I hate all this waiting.... it would be easier if I just knew what to expect. I'm thinking of contacting my attorney and asking him to deal with them.

Boy, glad I read this before filing. Paid my car off last June and they never sent me the title!

Ok well just an update to this post... I finally got in touch with the person that handles bankruptcy accounts at the credit union, and she said she would have the lien release ready for me to pick up today. So that is a relief, but yeah, I guess it would have gone smoother if I'd have thought of this before filing! Now just waiting on discharge confirmation!
