    to affirm or not???

    we will be retaining a lawyer soon. but have another question?

    is there any time, in any any state, that the lender will try to take the home if you did not reaffirm the home loan and are still current?

    I'd like to know also. Now that dh is unemployed it really makes a difference.

      Mortgage lenders can't just take your house because they want to. If your payments are sent in time to post an on-time payment by the due date (not the grace period), then you should be good. (A few greedy lenders have been known to not post payments in a timely manner trying to cause issues, but I haven't heard anything about this practice since the economy went into the toilet.)

      A few states have laws that specifically forbid any lender to repossess assets if payments are made on time. Ask your lawyer if your state is one of those.
