    stop paying before file?

    If I stop paying everything and spend my cash on other things will they say since you are not paying it you can't put it in as monthly bills?? If I haven't payed my mortgage for 6 months do I still put that in as a bill?

    Ok, my attorney told me to stop paying on all NON-COLLATERALIZED bills - C Cards and the like as these will be discharged in BK 7 - and any collateralized bills that I did not intend to keep like furniture or such as these will be repoed. To keep paying all utilities and such.

    Suggested I continue paying house payments IF I intended to keep the house.

    When you fill out all the paperwork for BK, one of these will be your income and one your expenses - in detail. The forms are pretty straight forward and cover EVERYTHING.

    Ideally, your expenses and income should be close to the same for a chp 7. - jb

      I am way under the means test and even on paper if I am paying the bills and mortgage which I don't have enough money to pay them all. So if I stop paying them all say 6 months ago does that matter on the test? I still put them down as an expense I have to pay right?

        If you want to keep a secured asset after filing Ch 7, you have to be up to date on the payments when you file.

        Whether you can continue to claim the payment for an asset you intend to surrender when you file depends on your bk district's position on the issue. Some allow it, some don't.
