    I'm going to be filing BK soon. I'm engaged and am going to get married as soon as the whole mess is over.

    I have about $11000 I need to get rid of before I file. I was going to use it as a down payment on a new car (NV allows $15000 in equity in a vehicle). I was just double checking this with my attorney and she said that I can also use this money on wedding expenses prior to filing. She said I could use it to buy the dress, deposit for the place, flowers, pay caterer ect.....

    Does this seem right to you?

    I would actually prefer to use the money on the wedding. I know, I'm a stupid girl who wants a wedding. Do you think this will fly with the trustee or do you think it would be better to go for the car?

    I would pay for the wedding stuff and get DH to be to cosign a loan for a car after you are married. that will help you get your credit rebuilt.

          Ok.. thanks! I'm guess I'm not up on my married lingo yet!

          So does anyone think that it seems strange that you can spend money on a wedding prior to filing BK? It seems weird to me. Wouldn't the trustee be upset that I spent money on something that isn't a necessity?

            Nope your not in debtor prison It's isn't the trustee's job to figure out what are necessity or not. the trustee is looking for assets he can sell.

              I understand the wedding thing.

              Why don't you just pull out cash to pay your vendors? then who cares-- I mean, if they ASK you where the money went, of COURSE you tell BUT that doesn't mean you have to pay by checks and leave a trail waiting to be questioned.

              I'm not saying to HIDE IT. I'm saying don't put it right under his nose...

                Frankly seeing large cash withdrawals right before filing would look more suspicious to her trustee than seeing receipts for purchases of wedding goods.

                NNS, if you do go the cash route, save every single receipt in case your trustee does question where the cash went. You need to be able to prove where the money went.

                  I was in the same situation, minus having 11k I was sitting on ;) Because I didn't have that extra cash around, and therefore didn't have to explain any money or last minute big spending, I just included my engagement ring in my schedule. I actually, in retrospect, think that making sure the trustee realized I was engaged helped her to have an immediate explanation, beyond my income vs debt ratio, of why I needed a fresh start. She mentioned my engagement ring and said congratulations. I didn't know if they would think $2500 on a photographer and $1500 on flowers for one day of my life was considered extravagant or not, but looking back, I think downpayments for these things would have been fine. Right after my 341, I started making payments on all of these things.

                  Your lawyer knows the trustees in your district far better than anyone on here will. If she says that's acceptable, I would trust her. I wouldn't go overboard and get a $8k Vera Wang wedding gown or anything, but paying for a huge chunk of your wedding would be a nice head start into your new life.

                  One note of caution: I would make sure that your finances are as seperate as possible from your future husband. The only extra questions in my 341 were regarding our financial ties. She asked if I had a joint account with anyone or bills created with anyone several times in several different ways. Not sure how it would have changed things if our finances had been linked up already, but fortunately with my "no's" for every extra question, my entire 341 lasted less than 3 minutes.

                  I'm hopeful that my case with be discharged and closed on April 3rd (right at my 60 days!) I am getting married May 23rd. LOL! Timing :/
